1. Who We Are

This website, www.tridentlaserworks.com (the "Site"), is operated by Trident LaserWorks, LLC, a Pennsylvania limited liability company located at 75 Ricks Rd., New Ringgold, PA 17960 ("Trident LaserWorks," "we," "us," or "our"). Our store runs on Shopify. These Terms of Service ("Terms") apply to everyone who visits the Site, uses our design tools, or buys products or services from us (the "Services").

2. Accepting These Terms

By using the Site or placing an order, you agree to these Terms and to our Refund Policy, Shipping Policy, and Privacy Policy, which are part of these Terms. You must be at least 18, or the age of majority where you live, to place an order. If you order on behalf of a company or organization, you confirm you are authorized to bind it to these Terms.

3. Orders, Pricing, and Payment

An order is accepted when we confirm it, not when you submit it. Prices are in U.S. dollars unless your checkout shows another currency, and they exclude applicable taxes and shipping unless stated. Volume discounts apply as shown on each product page. We may correct pricing or description errors, and we may cancel or refund an order affected by an error, suspected fraud, or our inability to produce it. If we cancel a paid order, we will refund you in full.

4. Custom Orders and Your Artwork

Most of our products are made to order using artwork, text, logos, or other content you provide ("Your Artwork"). When you submit Your Artwork, you confirm that:

You own it, or you have permission from the owner to reproduce it on the products you order.
It does not infringe anyone's copyright, trademark, right of publicity, or other rights.
It is not unlawful, defamatory, obscene, or hateful.

We may refuse or cancel any order, at our discretion, if we believe Your Artwork may infringe someone's rights or violate this section. This includes third-party brand logos, sports or entertainment marks, and official military or government insignia used without authorization. If we cancel before production, we will refund you in full. If we learn of a problem after production has started, we may keep a reasonable amount for work already completed.

You keep ownership of Your Artwork. You give us a limited, non-exclusive license to use it only to review, prepare, produce, and deliver your order and any reorders you request. We will not use Your Artwork or photos of your finished products in our marketing without your permission. We keep uploaded files for 12 months after your order to support reorders, unless you ask us to delete them sooner.

5. Mockups, Approval, and Production Variation

Our online builders and any proofs we send show how your order will be produced. When you approve a mockup in a builder, or approve a proof we send, you authorize us to produce the order exactly as approved. Please check spelling, size, shape, color, material, placement, and cut lines carefully before approving. We are not responsible for errors that appear in an approved mockup or proof.

Changes requested after approval may add cost or production time, and may not be possible once production has begun.

Because our products are made one at a time on physical materials, small variations are normal and are not defects. These include:

Color differences between screens and printed or engraved results.
Natural variation in leatherette, canvas, metal, acrylic, and drinkware finishes.
Minor differences in size, placement, cut line, or texture height.

We may make small technical adjustments needed for production, such as cleaning artwork edges or adjusting cut paths, without changing the approved design.

6. Our Intellectual Property

The Site's content, including our text, photos, product designs, pre-made designs, builder tools, and the Trident LaserWorks and Mission Ready names and logos, belongs to Trident LaserWorks, LLC or its licensors. You may not copy, reproduce, or resell it without our written permission. Buying a product with one of our pre-made designs gives you the product, not the right to reproduce the design.

7. Blank, Wholesale, and Resale Purchases

You may buy blank products, DTF and UV DTF transfers, and bulk or wholesale orders to resell or to decorate for your own customers. When you do, you are responsible for the artwork you or your customers use, for applying transfers correctly, and for your own customer service and legal compliance. 8. Production and Shipping

Production and shipping times are estimates. Current processing times are listed in our Shipping Policy. If we cannot ship your order within the time stated, or within 30 days if no time is stated, we will notify you with a revised date and give you the option to cancel for a full refund. Risk of loss passes to you when the carrier delivers your order. Some products, such as lithium battery items, can only ship to certain destinations or by certain methods.

9. Returns, Refunds, and Defects

Returns and refunds are handled under our Refund Policy. Custom and personalized items are made to your specifications and are not returnable unless they arrive damaged, defective, or do not match the approved mockup or proof. If there is a problem with your order, contact us within 15 days of delivery with photos, and we will reprint, replace, or refund the affected items.

10. Accuracy of Information

We work to keep product descriptions, photos, and availability accurate, but errors can happen. We may correct errors, update information, or discontinue products at any time. Product photos may show sample designs or optional upgrades.

11. Product Use and Care

Use products only as intended and follow any care or safety instructions provided. Electronic items, including power banks and chargers, must be used, charged, stored, and disposed of according to the manufacturer's instructions. Do not use damaged, swollen, or overheated batteries. Laser engraved and UV printed finishes can wear with abrasion, harsh chemicals, or high-heat dishwashing.

12. Reviews and Other Submissions

You may post product reviews and other content on the Site. Your content must be truthful, reflect your own experience, and must not infringe anyone's rights or contain unlawful, abusive, or obscene material. You grant us a non-exclusive, royalty-free license to display and share your review in connection with our business. We may remove content that violates these Terms. We do not pay for reviews or suppress reviews because they are negative.

13. Online Tools and AI Recommendations

The Site includes design tools such as the Patch Builder, Hat Lab, mockup previews, background removal, and the Mission Ready Patch Advisor, which may use AI to suggest options. Previews and recommendations are guides, not guarantees. You are responsible for reviewing and approving the final configuration. Some tools rely on third-party services and are provided "as is."

14. Prohibited Uses

You may not use the Site or Services to: (a) break any law; (b) infringe our or anyone else's intellectual property or privacy rights; (c) harass, defame, or discriminate against others; (d) submit false or misleading information; (e) upload malware or interfere with the Site's security or operation; or (f) scrape, spider, or collect data from the Site without our written permission. We may suspend or end access for violations.

15. Disclaimer of Warranties

Except as expressly stated in these Terms or our policies, the Site and Services are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. Nothing in these Terms limits warranties or rights that cannot be excluded under applicable law.

16. Limitation of Liability

To the fullest extent permitted by law, Trident LaserWorks, LLC and its owner, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data. Our total liability for any claim related to an order or the Services will not exceed the amount you paid for the order involved. Some jurisdictions do not allow these limits, so some may not apply to you.

17. Indemnification

You agree to defend, indemnify, and hold harmless Trident LaserWorks, LLC and its owner, employees, contractors, and suppliers from any claims, losses, damages, and expenses, including reasonable attorneys' fees, arising from: (a) artwork or content you submit, including claims of intellectual property infringement; (b) your breach of these Terms; or (c) your violation of any law or third-party right.

18. Governing Law and Venue

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law rules. Any dispute will be brought exclusively in the state or federal courts located in or serving Schuylkill County, Pennsylvania, and you consent to their jurisdiction. Before filing a claim, please contact us so we can try to resolve the issue informally.

19. General Terms

If any part of these Terms is found unenforceable, the rest stays in effect. Our failure to enforce a provision is not a waiver. These Terms, together with our Refund Policy, Shipping Policy, and Privacy Policy, are the entire agreement between you and us about the Site and Services. Bulk or wholesale quotes we issue in writing may add terms that apply to that order. We may update these Terms by posting a revised version with a new "Last updated" date; changes apply to orders placed after that date.
